VK has filed a lawsuit against three Apple entities with the Moscow Arbitration Court, TASS reported, citing the holding’s press service. The lawsuit was registered on August 19. The defendants are the Russian legal entity OOO “Apple Rus,” Apple Inc., and Apple Distribution International Limited. VK demands to recover 58 million rubles a day from them in case of non-fulfillment of a future court decision to restore three of the company’s applications in the App Store. As of the time of publication 58 million rubles is equal to $670,000 USD.
VK stated that Apple unilaterally removed the holding’s applications from the App Store without warning. The company demands the return of its services to the store, the restoration of the ability to receive push notifications, and compensation for non-compliance with the court’s decision.
Earlier, “VKontakte,” “VK Music,” “VK Video,” “Dzen,” “Odnoklassniki,” and other products disappeared from the App Store; later, some of them also disappeared from Google Play.
Apple explained the removal by compliance with sanction rules. VK insisted that the holding had never been under sanctions. The Ministry of Digital Development called the decision politically motivated, and the FAS issued a warning to Apple due to discrimination against Russian services. The court of first instance will begin considering the case on its merits.
They are seeking a fine of 50 million rubles a day for the VK social network, Odnoklassniki social network – 3 million rubles a day, and VK Music service – 5 million rubles a day according to the agency interlocutor. The plaintiff requests to collect the penalty starting from the sixth day from the date of the production of the judicial act in full, the press service clarified.
The press service of the plaintiff company earlier on Friday told RIA Novosti that VK’s lawsuit requires Apple to return the company’s applications to the App Store, restore the ability for users to receive notifications from applications and collect a penalty in case of non-compliance with the court decision.
